Modest Proposal: Truce?

Regular readers of the comments section here will know "BTL Guy." He's a crew member (protecting his identity) who supports a fair deal for writers and strong unions but doesn't think the WGA leadership should have called the strike when they did. He recently sent me a Modest Proposal and has posted it on his blog, Divided Hollywood. (And yes, as much as I respect BTL Guy, that name, grrr!)

    Last week, the studios proposed a residual fee of $250 for the unlimited
    reuse of our content online for one year. Let's just assume for a moment
    that such a low fee is fair. If that's really all the studios should pay to
    reuse our content, then I think we should encourage advertisers to demand
    something similar: $250 for the unlimited reuse of a time slot.

    Under the current system, when an advertiser, Budweiser say, buys a
    timeslot, they only get to play their expensive commercial ONE TIME. That
    doesn't seem fair, does it? Wouldn't it make more sense for Budweiser to buy
    a thirty second slot during Sunday night primetime, and then for a fee of
    $250 get to use that timeslot over and over for the rest of the year?

    Attention all SAG Actors:

    I believe it's appropriate at this time to call all actors into action in support of the Writer's Guild on strike.
    I know many of us have been walking the picket lines and attending the rallies, but I want to challenge ALL SAG members to see if they can commit an HOUR-A-DAY to walking the picket lines.
    The AMPTP has been jerking the Writer's Guild around.
    1. They offered nothing but insulting Roll-Backs to the WGA in the negotiations that caused the strike.

  • The last day of official picketing ended with a high point at Fox.

    Writers were joined on the picket line by many supporters. The honking at the Pico gate reached new decibel levels as crowds of picketers filled the sidewalk and waved their signs at the passing traffic.

    The signs told the story: "WGA-DGA-SAG", "The House is Not Divided," "DGA-WGA Member," "Union Solidarity".

    The appearance of so many SAG and DGA members made the point that even though the AMPTP spin machine works hard to create the impression that there is dissension between the unions and in the ranks of the WGA, the opposite is true.

    Of course the strike has created tensions. How could it not?

    There should be tensions when so much is at stake and so much has been sacrificed in the fight with the congloms. But our common interests outweigh that tension, and our solidarity is real.

  • This is the first of what we hope will be a number of "calls to action."

    As of last week, the AMPTP retained the powerhouse "crisis management" firm of Fabiani and Lehane (known in political circles as "the Masters of Disaster." )They also have "a reputation for hardball tactics in damage control and inflicting damage on opponents."

  • Patric Verrone and Michael Winship just sent this message to the membership. The WGA is determined to stay at the table until we have a deal. If the AMPTP wants to negotiate in good faith, and end the strike, we are at the table.

    Before we head into negotiations this morning, we want to give you an update on where we stand.

  • United Hollywood has secretly obtained a transcript of one of the earlier negotiating sessions which illustrates just what the writers are facing at the bargaining table...

    WGA: We'd like a whopping four pennies more on each DVD sold.
    AMPTP: We're going to punch you in the face and take your dog.
    WGA: We'd like to be compensated for our work that's distributed over the Internet.
    AMPTP: We're going to punch you in the face and take your dog.
    WGA: We don't think it's fair you're trying to have short-form content written non-guild.
    AMPTP: Fine. We won't take your dog. That's off the table. After you shout from the rooftops and thank us, which proposal are you going to take off the table?

    AMPTP BREAKS OFF NEGOTIATIONS

    Today, after three days of discussions, the AMPTP came back to us with a proposal that included a total rejection of our proposal on Internet streaming of December 3.

    They are holding to their offer of a $250 fixed residual for unlimited one year streaming after a six-week window of free use. They still insist on the DVD rate for Internet downloads.

    They refuse to cover original material made for new media.

  • On Monday, February 11 from 2-6pm, United Hollywood and Strike Swag invite all members of the United Hollywood community to be photographed for a PR campaign to promote the new United Hollywood site.

    The concept of the campaign is to show writers, actors, directors, crew, staff and fans standing united to meet the challenges of the digital present. That's right, the challenges of now.

    Why Production Crews Should Be Cheering On the Writers

    I’ve talked with a few IA guys over the past few days, and they were generally unaware of a few things in their own contracts with the Alliance. To whit:

    1) Their unions, including I.A.T.S.E., IBT Local 399, Studio Utility Employees Local 724, IBEW Local 40, Plumbers & Pipefitters Local 78, and the Plasterers & Cement Masons Local 755… ALL RECEIVE RESIDUALS.
    2) These residual payments go directly into their PENSION AND HEALTH FUND.
    3) RESIDUALS earned working on shows CONSTITUTE 55% OF THEIR P & H.
    4) If there are funding surpluses from residuals, retirees receive a 13th and a 14th check in that year, instead of the normal twelve.

  • Two articles in the New York Times today (11/16/07) put a personal perspective on the strike. Bill Carter's "Late Shows Move to Help The Workers Not on Strike" and Jennifer Steinhauer's "Writers' Strike Opens New Window on Hollywood".

    Carter reports about efforts by Talk Show Hosts to keep their staffs paid, even if they can't be on the air. Steinhauer profiles the personal stories of writers, costumers, assistants, electricians, and thousands of others who are now or who will soon be out of work.

    What these stories have in common is one underlying fact: the AMPTP won't sit down with the WGA.

    Notwithstanding the AMPTP's full page ads, they'd rather spend their energy and money on avoiding talking to the writers and negotiating a fair deal. And why?

    It’s déja vu all over again in Hollywood.

    On October 31, 2007, the day the WGA’s contract with the studios was set to expire, the AMPTP issued the following statement to the WGA:We’ve been working hard to come up with a package in response to your last proposal. But we keep running up against the DVD issue. The companies believe that movement is possible on other issues, but they cannot make any movement when confronted with your continuing efforts to increase the DVD formula, including the formula for electronic sell-through.

  • Today, Tuesday, 11/20/07, Los Angeles will experience a labor rally in support of the WGA strike. Marching west on Hollywood Boulevard from Ivar and gathering in front of Grauman's Chinese Theater, thousands upon thousands will join together to celebrate the importance of labor unions in American life.

    And how will you know about this momentous occasion? You'll have to be there.

    At the last rally in front of Fox Studios, 4,000 writers and their supporters marched and rallied, but when you watched the evening news, you'd never know it . There was plenty of time that night to talk about lost kittens but nothing about the peaceful march that closed down Pico Boulevard and Avenue of the Stars.

    Today's rally marks a crucial juncture: a mass demonstration of our strength before the negotiations restart.

    We get the impression, in this third month of the Hollywood writers strike, that morale on the picket lines and in the coffee shops isn't so hot. That's odd, given how strong the writers are looking right now.

  • The California Democratic Party is officially on record as supporting the WGA's strike action. Stating in their resolution:

    WHEREAS, the Association of Motion Picture and Television Producers (AMPTP) has refused to recognize the legitimate claims of the approximately 12,000 members of the Writers Guild of America (WGA) to fair remuneration through residuals on the distribution of its members’ creative endeavors on any current distribution platforms and those yet to be developed, including the monitoring and enforcement thereof; and

    If the consequences weren’t so tragic, it would be pretty comical to see the Companies mocking our Executive Director David Young for never having made a deal in Hollywood. Of course he has made deals for us, four of them (including the Comedy Central deal and the “Family Guy” game deal), but yeah, he’s never before negotiated a contract with the AMPTP.

    Call me crazy, but I think that’s a good thing, because it means he’s never made a lousy deal, never made a sweetheart deal; he’s never been chummy with Nick Counter, and he refuses to bend over and give them what they want and expect. He’s not part of their club. Thank God.

  • The strike is over. The WGA contract has been ratified. SAG and AFTRA are now center stage and there is still a lot of work to do before the town gets back to normal. At this moment it's useful to look back at our own history. There are lessons to be learned about how the process can move forward even against what seems like overwhelming odds.

    There are many who labored behind the scenes to support the writers' strike. At United Hollywood we worked with people who put their energy on the line but wanted to stay off the media's radar. Not content to just talk a good game, these are members and supporters who knew that if they wanted to make a difference, they had to work at it.

    One group in particular came of age during the early part of the strike: the writer-directors. Nicknamed the WD-40, forty writer-directors met to search for ways they could help facilitate the negotiation.

    From the beginning of the strike, most journalists accepted the AMPTP's lead and described the DGA and WGA as antagonistic to one another. Nicholas Counter was frequently quoted in the trades as preferring the DGA as a negotiating partner. The writer-directors objected to that characterization and felt that the AMPTP was doing what it always did in positioning the Guilds against one another to diminish each union's power.

    Last night was a literary evening at my house. After "Go, Dog, Go!" and "One Fish, Two Fish, Red Fish, Blue Fish" we continued the Ingalls' family saga with a chapter of "Little Town on the Prairie." After my kids fell asleep I settled down to look at the AMPTP's latest proposal to the WGA.

    I really should have stuck with P.D. Eastman & Dr. Seuss. A big dog party up there in the tree is something I can believe in. But $250.00 in residuals? For a whole year? Really?

    I couldn't resist grabbing a paper towel and pen to try and figure out what this proposal means for those of us below the line.

  • To Our Fellow Members:

    Yesterday, the WGAW and WGAE presented to the AMPTP a response to its proposal on streaming television programs.

    We accepted the framework in their proposal of last Thursday for a fixed residual in the first year.

    But rather than basing the residual for the entire first year on a small percentage of the applicable minimum, we proposed that the fixed residual be paid on a higher percentage of applicable minimum for each 100,000 streams per quarter.

    This is a readily ascertainable number. In fact, the companies are already keeping records of streams for their advertisers. Both the advertisers and the companies are already using these numbers as the basis for their business model.

  • United Hollywood is keeping CBS mogul Les Moonves in its thoughts and prayers. As Bloomberg news reports, Moonves signed a new compensation package worth, on the low end, $30 million dollars per year. But shockingly, his base salary was cruelly cut from $5.6 million in 2006 to a mere $3.5 million in 2007. Such a devastating loss of income must be particularly difficult around the holidays. It certainly is for all of us on strike or put out of work.

    Perhaps when this strike is resolved -- and we writers, below the line crew, actors and directors have our income restored -- we can all chip in to help Les Moonves through his time of need. Until then, Les, if you need a place to crash, I have a futon.

    Los Angeles – Paul Howes, national secretary of the 135,000-strong Australian Workers’ Union, joined striking writers on the picket line in front of Fox Studios today in Los Angeles. In California for various meetings, Howes asked to meet with the WGA and discuss mutual labor issues.

    We did it. We accomplished the impossible. We got the AMPTP back to the table and finally received a counter-proposal to the one we made them so many months ago. The deal they made with the DGA is the first true sign of negotiation they’ve shown since we started asking them to do so back in July.

    It's not officially over yet, of course. There still is the matter of approving the contract. It's a 10-day process, a blink by strike standards, but long enough. Arguments of all views will be made, we do know that -- these are writers after all

  • Gosh, I don't know. Do you?

    I've been asked many times if the strike is going to end this week. Nikki Finke posted a very optimistic report from an insider yesterday morning, and that has set off a wave of enthusiasm. "Fire up the margarita machine!" you say.

    Well, not so fast. First of all, it's November, and who drinks margaritas in November?

  • Uh oh. Never trust the smile of a crocodile?

    Alex Ben Block of Hollywood Today reports that the AMPTP's public gestures of reconciliation may mask a plan to derail negotiations and cancel Christmas.There are signs the writers unity is working – reports of dissention among the ranks of the AMPTP’s key members; a softer stance by management in PR and negotiations in the past few days; and comments suggesting that management proposals are flexible.

    However, what I am hearing is that this could be another sucker punch for the writers, who think they have finally broken though into a new level of negotiations where the two sides talk things over instead of talking at each other.
