Last night was a literary evening at my house. After "Go, Dog, Go!" and "One Fish, Two Fish, Red Fish, Blue Fish" we continued the Ingalls' family saga with a chapter of "Little Town on the Prairie." After my kids fell asleep I settled down to look at the AMPTP's latest proposal to the WGA.

I really should have stuck with P.D. Eastman & Dr. Seuss. A big dog party up there in the tree is something I can believe in. But $250.00 in residuals? For a whole year? Really?

I couldn't resist grabbing a paper towel and pen to try and figure out what this proposal means for those of us below the line.

The AMPTP is counting on us becoming more divided as time goes on. But we believe the opposite will happen -- is happening, right now. We are staying strong.

To my fellow WGA Members,

I want to clear up any misunderstanding about where I stand.

On November 16 I, regretably, was quoted by a Wall Street Journal reporter saying I was going to perform some of my non-writing, post-production duties on episodes of LOST to protect the show for the fans. However, I'm sure to the delight of the AMPTP, my statement became the story and gave the false impression that there was disunity among showrunners over the issues of this negotiation.

Why Production Crews Should Be Cheering On the Writers

I’ve talked with a few IA guys over the past few days, and they were generally unaware of a few things in their own contracts with the Alliance. To whit:

1) Their unions, including I.A.T.S.E., IBT Local 399, Studio Utility Employees Local 724, IBEW Local 40, Plumbers & Pipefitters Local 78, and the Plasterers & Cement Masons Local 755… ALL RECEIVE RESIDUALS.
2) These residual payments go directly into their PENSION AND HEALTH FUND.
3) RESIDUALS earned working on shows CONSTITUTE 55% OF THEIR P & H.
4) If there are funding surpluses from residuals, retirees receive a 13th and a 14th check in that year, instead of the normal twelve.

We did it. We accomplished the impossible. We got the AMPTP back to the table and finally received a counter-proposal to the one we made them so many months ago. The deal they made with the DGA is the first true sign of negotiation they’ve shown since we started asking them to do so back in July.
That, my friends, is a great victory

Perhaps I was a little harsh on the Commonwealth Bank when I rubbished their latest campaign for failing to understand the Australian consumer and their attitude to banks.

Now I realise, that by taking up it's mortgage rate by more than the official rise, they really are "Determined to be Different"!

I suppose they had a choice didn't they? Customers or profit. Guess which won again?

In his now-famous piece "Suicide by Strike," Marc Andreessen pointed out in November that by denying writers (and actors and directors) a fair share of New Media, the corporations were beginning the process of making themselves obsolete. Basically, he says it's a pretty bone-headed thing for them to do, all to save a few cents on the dollar. -

AMPTP BREAKS OFF NEGOTIATIONS

Today, after three days of discussions, the AMPTP came back to us with a proposal that included a total rejection of our proposal on Internet streaming of December 3.

They are holding to their offer of a $250 fixed residual for unlimited one year streaming after a six-week window of free use. They still insist on the DVD rate for Internet downloads.

They refuse to cover original material made for new media.

Based on blog comments and conversations I've had, many members seem to think that the so-called "Initial Streaming Window" is just another way for the Companies to screw the Writers. It isn't. Not in principle, anyway.

This latest Commonwealth Bank campaign got me thinking.....how far off the mark are these guys and what really is a relevant insight for a banking customer?

And do you have to employ an american ad agency and feature the bloke who directed Transformers to bring that insight to life?

Maybe the client got sucked into the typical ad agency hype about how an ad has to be funny for it to be effective. I've had this shoved in my face so many times without any insight back to how the target is likely to respond to it in the context of what the brand is trying to say.

So here's the thing. 20 years ago the State Bank of Victoria created an amazing campaign that worked it's way into the vernacular with four words - "It's your money Ralph".

It's not funny. It's just true. And it struck a major chord.

United Hollywood has secretly obtained a transcript of one of the earlier negotiating sessions which illustrates just what the writers are facing at the bargaining table...

WGA: We'd like a whopping four pennies more on each DVD sold.

Dear Writers Guild of America Members,

I am writing to you on behalf of 120,000 proud members of Screen Actors Guild who stand with you in solidarity as your strike continues. We believe that now more than ever, we must remain strong and even more committed to achieving our common objectives. We are proud to walk shoulder-to-shoulder with you and SAG will be there for as long as it takes.

Your fight is our fight. Our National Executive Director Doug Allen and I are working around the clock with Patric Verrone and David Young to coordinate our strike support efforts. I'm sure you have seen some of the thousands of Screen Actors Guild members who've been walking the picket lines in Los Angeles, New York and around the country for the last six weeks.

Toronto's Globe and Mail newspaper is reporting that UA wasted no time and has a tentative deal with Paul Haggis to co-write an adaptation of the Ranger's Apprentice series of young-adult adventure novels.

Today, Tuesday, 11/20/07, Los Angeles will experience a labor rally in support of the WGA strike. Marching west on Hollywood Boulevard from Ivar and gathering in front of Grauman's Chinese Theater, thousands upon thousands will join together to celebrate the importance of labor unions in American life.

And how will you know about this momentous occasion? You'll have to be there.

At the last rally in front of Fox Studios, 4,000 writers and their supporters marched and rallied, but when you watched the evening news, you'd never know it . There was plenty of time that night to talk about lost kittens but nothing about the peaceful march that closed down Pico Boulevard and Avenue of the Stars.

Today's rally marks a crucial juncture: a mass demonstration of our strength before the negotiations restart.

This is actually no shock to me at all. Except, I prefer cats.
