(Real) AMPTP Attempts Humor, Fails

In nominating the WGA for "worst supporting union," the AMPTP's PR machine revealed its newest tactic: snarky bitchery! A reader replied in kind and sent us this:

In the category of Best Negotiator Ever, the nominee is Nick Counter. This modern hero has done everything humanly possible to end the strike. As if keeping the studios from making a good faith economic proposal wasn't enough, Counter has even gone so far as to WALK AWAY from the bargaining table completely, not once, but twice. While the refusal to negotiate (which Topher Lehane referred to as "a, like, totally sweet plan" in his senior quote) continues to hurt writers, below the-line crew, their families, the Los Angeles region, advertisers and company shareholders, we applaud Nick Counter's bravery in demanding that absolutely no new talks take place until the WGA has submitted to several unreasonable ultimatums. Then, and only then, can true negotiations begin.

  • Patric Verrone and Michael Winship just sent this message to the membership. The WGA is determined to stay at the table until we have a deal. If the AMPTP wants to negotiate in good faith, and end the strike, we are at the table.

    Dear Fellow Members,

    Before we head into negotiations this morning, we want to give you an update on where we stand.

  • This is the letter that was just sent to the membership:

    AMPTP BREAKS OFF NEGOTIATIONS

    Today, after three days of discussions, the AMPTP came back to us with a proposal that included a total rejection of our proposal on Internet streaming of December 3.

    They are holding to their offer of a $250 fixed residual for unlimited one year streaming after a six-week window of free use. They still insist on the DVD rate for Internet downloads.

    They refuse to cover original material made for new media.

  • The last day of official picketing ended with a high point at Fox.

    Writers were joined on the picket line by many supporters. The honking at the Pico gate reached new decibel levels as crowds of picketers filled the sidewalk and waved their signs at the passing traffic.

    The signs told the story: "WGA-DGA-SAG", "The House is Not Divided," "DGA-WGA Member," "Union Solidarity".

    The appearance of so many SAG and DGA members made the point that even though the AMPTP spin machine works hard to create the impression that there is dissension between the unions and in the ranks of the WGA, the opposite is true.

    Of course the strike has created tensions. How could it not?

    There should be tensions when so much is at stake and so much has been sacrificed in the fight with the congloms. But our common interests outweigh that tension, and our solidarity is real.

    December 13, 2007

    To My Fellow Members:

    The AMPTP and each of its member companies have a legal obligation to bargain in good faith with the WGA. Their unilateral walkout from negotiations last Friday and their on-going refusal to bargain is illegal under the National Labor Relations Act. Therefore the WGA today filed Unfair Labor Practice charges against the AMPTP with the National Labor Relations Board.

    The DGA’s announcement today that it may begin negotiations with the AMPTP in January in no way relieves the AMPTP of their legal obligation to negotiate with us. The only legal way for the AMPTP to remedy the Unfair Labor Practice charge we have filed is to return to the bargaining table.

  • Statement from Chief Negotiator David Young and the WGA Negotiating Committee.

    We have attempted to negotiate with the AMPTP companies since July. First they ignored our opening proposals. Then they told us we had to choose between their two horrible proposals. Then we removed DVDs from the table. Their response was to walk out of negotiations and tell the press that we were the ones who walked. Last week they presented us with another set of ultimatums. They didn’t even wait for a reply but broke off negotiations and walked out again.

    There is a strategy at work here.

    In any negotiation there are bottom line goals and “fringe” goals. The AMPTP wants to make the WGA reduce our demands to the bottom line so we’ll negotiate down from an acceptable deal to a bad deal If we do this, as we did with DVDs, you can be sure they would not hand us the deal we want. They would simply try to further wear us down.

    If the consequences weren’t so tragic, it would be pretty comical to see the Companies mocking our Executive Director David Young for never having made a deal in Hollywood. Of course he has made deals for us, four of them (including the Comedy Central deal and the “Family Guy” game deal), but yeah, he’s never before negotiated a contract with the AMPTP.

    Call me crazy, but I think that’s a good thing, because it means he’s never made a lousy deal, never made a sweetheart deal; he’s never been chummy with Nick Counter, and he refuses to bend over and give them what they want and expect. He’s not part of their club. Thank God.

  • (Nick Counter and the AMPTP (The Media Moguls) paid for an expensive ad in yesterday's "Variety" -- for those of you who don't work in the industry, "Variety" is an entertainment business magazine that is in the pocket of the Media Moguls.

    Since we don't have tons and tons of money like the Media Moguls do, we'll have to respond here - on the Internet - which they don't entirely own and control ( but they sure would like to).

  • Last week a coalition of WGA members went to NYC to talk with the seven largest media buyers on Wall Street.

    These ad buyers are the large corporations (like Proctor & Gamble, Johson & Johnson, etc.) who advertise on TV and pay the networks' bills.

    Our WGA crew, lead by Matthew Weiner, showrunner of "Mad Men," laid out our position to the advertisers -- who for some reason might not be getting entirely accurate forecasts from their corporate customers like CBS.

    The event was a success. The coalition of media buyers agreed that our demands are reasonable and that it was "irresponsible on the part of the networks not to settle this dispute immediately."

  • The AMPTP walked away on Friday. The WGA never left the table.

    The Guild has made itself crystal clear: Specific proposals have been detailed, compromises have been made, the leadership continues to be engaged in a constructive dialogue to quickly resolve the strike. The AMPTP is as clear about its position: You can't talk to writers because they're emotional and don't understand business.

    With the AMPTP away from the table, the negotiation is playing out in the press. If you read Dave McNary in Variety today, there's only one answer to the impasse: the WGA has to accept the companies' demands and get back to work. The companies are too powerful, with their deep pockets and experienced PR resources. The writers' are too emotional, which is great when they're writing screenplays, but not good when you're engaged in a difficult labor negotiation.

    It’s déja vu all over again in Hollywood.

    On October 31, 2007, the day the WGA’s contract with the studios was set to expire, the AMPTP issued the following statement to the WGA:We’ve been working hard to come up with a package in response to your last proposal. But we keep running up against the DVD issue. The companies believe that movement is possible on other issues, but they cannot make any movement when confronted with your continuing efforts to increase the DVD formula, including the formula for electronic sell-through.

  • We shouldn't get all misty-eyed at the revelation that the studios are happy the strike has happened.

    Jeff Zucker picks up an easy $40 million by terminating overall deals. Peter Chernin is the face of reality when he boasts, "We save more money in..., you know, story costs and probably the lack of making pilots than we lose in potential advertising."

    We shouldn't be surprised that a cable network told a tv-writer last week that her movie will go into production, but before they green light her project, they need the tiniest of rewrites before they green light. They know the WGA doesn't want her to do the work, but maybe she could 'supervise' someone else who could. Wink, wink.

  • United Hollywood is keeping CBS mogul Les Moonves in its thoughts and prayers. As Bloomberg news reports, Moonves signed a new compensation package worth, on the low end, $30 million dollars per year. But shockingly, his base salary was cruelly cut from $5.6 million in 2006 to a mere $3.5 million in 2007. Such a devastating loss of income must be particularly difficult around the holidays. It certainly is for all of us on strike or put out of work.

    Perhaps when this strike is resolved -- and we writers, below the line crew, actors and directors have our income restored -- we can all chip in to help Les Moonves through his time of need. Until then, Les, if you need a place to crash, I have a futon.

  • For those of you who missed this news, here is the announcement from Friday about bargaining with individual companies. Since the AMPTP has so many competing agendas and can't reach consensus, perhaps its individual members will consider their own self-interest and negotiate their own deals.

    I've been asked many times if the strike is going to end this week. Nikki Finke posted a very optimistic report from an insider yesterday morning, and that has set off a wave of enthusiasm. "Fire up the margarita machine!" you say.

    Well, not so fast. First of all, it's November, and who drinks margaritas in November?

  • Jane Hamsher at FireDogLake reports that Fabiani & Lehane, the formerly-Democratic PR firm, has been canned by SEIU Local 99 and will have lost all of its union clients by week's end. From Jane's post:"By the end of the week, I believe Chris Lehane will have no union clients because of his work for the AMPTP," says SEIU President Andy Stern, who confirms that all Change to Win Unions are severing ties with Lehane. "His days are numbered in the labor movement." ... Change to Win unions include the Teamsters, Laborers, SEIU, Carpenters & Joiners, United Farm Workers, Food and Commercial Workers, and UNITE HERE.

  • As Patric Verrone explained today, last Thursday, the AMPTP promised to offer up the second part of their "breakthrough" proposal. A week later, they still haven't added to the initial and unacceptable offer. The back channel conversations have only increased the widely-held impression that the AMPTP wants to prolong the strike. During the week, we've heard that two PR firms specializing in crisis-management have been hired by the studios at great expense, in an apparent effort to put an avuncular mask on the scowling face of the AMPTP negotiators.

    Every indication from the AMPTP is that their negotiators are getting ready to storm out of the room, exiting with their usual hand-wringing lament that writers are an unreasonable bunch of emotional artists.

  • Despite taking out full-page print ads touting their collusion unity, cracks are beginning to surface amongst the handful of major media corporations who make up the AMPTP's core decision makers.

  • The trades would have us believe that the AMPTP will start negotiations with the DGA as soon as next week, if the AMPTP satisfies "the DGA's condition that it can establish 'an apropriate basis for negotiations'."

    Why sit down with the DGA and not the WGA? Only the AMPTP knows the answer to that question, but for months, Nicholas Counter has said very publicly that he preferred to negotiate

    Not "some accountant in one of the AMPTP companies"...every single company has done extensive financial analysis on this situation, and it's what will drive all decisions made from the AMPTP side.

    Business decisions from executive management are based almost exclusively on finances...and often short term finances over long- or medium-term finances.

    AMPTP knows exactly when this strike will end.

  • The WGAW responded to the AMPTP today with the following statement:

    Mr. Counter's charge is as offensive as it is untrue. To accuse the Writers Guild of America of blacklisting, when it was we who suffered the most from it in the past, is simply Mr. Counter's desperate attempt to divert attention from the fact that it was he who walked out of the negotiations, and it is he who refuses every day to return to the table. The WGA has an offer on the table and is ready and willing to meet with the AMPTP any day, anywhere.

  • At today’s Los Angeles City Council meeting, over 300 writers and supporters came to hear Councilmember Eric Garcetti speak to the City Council about the writers strike, and the need to bring the AMPTP back to the table so negotiations can resume.

    The AMPTP did not bother to send a representative, apparently feeling that the $20 million a day damage to the Los Angeles economy is more the City Council's problem than theirs.

    Garcetti introduced an emergency motion asking for both parties to resume bargaining, and to come to a just and fair deal as quickly as possible. He also pointed out that the writers are still at the bargaining table, ready to negotiate, and called specifically on the AMPTP to return as well.

    Your fight is our fight. Our National Executive Director Doug Allen and I are working around the clock with Patric Verrone and David Young to coordinate our strike support efforts. I'm sure you have seen some of the thousands of Screen Actors Guild members who've been walking the picket lines in Los Angeles, New York and around the country for the last six weeks.

    You all should have, by now, gotten John Bowman's response to the "nice try" press release by the company's lap dog. Let me stress something that John mentioned - their press release came out minutes after they walked away.

    The latest AMPTP offer, Thursday's "groundbreaking" proposal, certainly wasn't what any of us hoped for. If we assume the AMPTP sincerely wants to end the strike, then everything they've done so far is counter-intuitive. Given the stakes, their behavior is crazy-making. Most members were shocked and demoralized that the offer was so inappropriate.

    But when has anyone enjoyed a negotiation?

    Personally, I hate negotiating. At first it feels good when I'm thinking about what I want. My mind's racing with the possibilities. But when the process starts and the first counter-offer comes in, I go through the seven stages of grief. If I want a deal that I can live with, I have to tough it out.

    Last week, the studios proposed a residual fee of $250 for the unlimited
    reuse of our content online for one year. Let's just assume for a moment
    that such a low fee is fair. If that's really all the studios should pay to
    reuse our content, then I think we should encourage advertisers to demand
    something similar: $250 for the unlimited reuse of a time slot.

    Under the current system, when an advertiser, Budweiser say, buys a
    timeslot, they only get to play their expensive commercial ONE TIME. That
    doesn't seem fair, does it? Wouldn't it make more sense for Budweiser to buy
    a thirty second slot during Sunday night primetime, and then for a fee of
    $250 get to use that timeslot over and over for the rest of the year?

    I know such an arrangement would be untraditional. It would cripple the
